Public Participation Opportunities under 40 CFR 25
In the implementation of its approved Pretreatment Program under the Clean Water Act, the Metro Wastewater Reclamation District must comply with the public participation requirements specified in 40 CFR 403.8(f)(2)(viii) and 40 CFR 25.2(a). The following document and associated information are provided in accordance with these requirements:
The Metro District's Rules and Regulations govern the operation, use, and services of the District’s system and were first issued in March 1971. The establishment and enforcement of the Rules is a requirement in the District’s Service Contracts with its Connectors. Any amendments or revisions to the Rules and Regulations must be approved by the Board of Directors, and revisions to certain sections that pertain to the District’s Pretreatment Program implementation must be approved by the U.S. Environmental Protection Agency (EPA).
Appointed in June 2016 by the Chairman of the Board, the Rules and Regulations Review Committee (Committee) was charged to work with Metro District staff to review and consider updates to the Rules and Regulations. The Committee solicited comments and suggested revisions from Metro District staff, Directors, and Member Municipalities at the beginning of the review process. The Committee then met with staff monthly over an 18-month period to review each section of the Rules and Regulations. Following an August 21, 2017, informational workshop attended by the Committee, other Directors, and Metro District staff, all Directors were asked to share the redlined sections with their Member Municipalities to provide an opportunity for these organizations to comment on the recommended revisions.
The Committee and Metro District staff are recommending that the Board of Directors adopt proposed amendments to several sections of the Rules and Regulations. However, Sections 5 and 6 and parts of Sections 2 and 10 of the Rules and Regulations are specific to the District’s implementation of its Pretreatment Program and are the subject of this notification and opportunity for comment. The revisions pertaining to the Pretreatment Program are proposed to ensure compliance with federal requirements and to provide clarity regarding the information and requirements included in these sections.
With this posting, the Metro District initiates an opportunity for interested parties to review and provide written comments regarding the proposed revisions.
