    Doing Business with the Metro District:

    Equal Opportunity

    The metro District is committed to fostering and maintaining an environment of equal opportunity for all firms without regard to race, religion, age, gender, national origin, sexual orientation, veteran status or physical limitations. In addition, the District requires that all vendors, contractors, and subcontractors doing business with the District agree not to discriminate against employees or other businesses for any of the reasons listed above.
    Purchasing and Awarding Process for Materials, Supplies, and Services

    Most Metro District purchases for material, supplies, and services are made by the Purchasing Division through a bidding process. A purchase order or a contract award is issued to the firm that can best meet the specified requirements of the Metro District at the most competitive price.
    • Purchases up to $5,000 - Bidding not required.
    • Purchases $5,000 to $25,000 - Informal bids.
    • Purchases over $25,000 - Formal bids.
    In awarding any purchase contract, the Metro District may impose conditions with regards to insurance, bonds and securities, and other guarantees of good faith and responsibility.

    In addition, the District Manager may place additional requirements or more detailed requirements on vendors of goods and services when the District Manager and Legal Counsel determine such requirements are in the best interest of the Metro District and are not contrary to any of its Board-approved policies. Such additional requirements may involve, but are not restricted to, insurance coverage and performance bond.
    Select and Award Process for Professional and Consultant Services

    The Metro District has an on-going need for engineering, legal, financial, scientific, and other professional services including, for example, auditing, computer systems, human resources, investment management, architectural design, structural design, and mechanical and electrical design. Consultants to perform these services are selected based upon an assessment of their professional competence, experience, and other relevant performance factors.

    Lists of firms interested in performing professional services for the Metro District are maintained, along with summaries of each firm's qualifications for particular types of work. The lists are normally supplemented by responses to advertising in local publications.

    Based upon these lists, and any responses from the advertisements, three or more qualified firms are selected and requested to submit formal proposals for the work. The information required in the proposals includes criteria such as: experience on similar projects, local capabilities, project team, references, and other factors the selection team determines appropriate. Oral interviews are often held to help in the final selection.

    Firms interested in performing professional services for the Metro District are encouraged to send current information on their qualifications for particular types of work and to watch the local publications for the Metro District's needs on specific projects. Firms interested in performing as subconsultants may contact the Metro District for the names of prime consultants being considered.
    Bidding and Awarding Process for Facility Construction Projects

    The Metro District has a continuing demand for construction contractors on a variety of general and specialty projects. Bids for this work are normally requested by advertising in local construction-related publications and by notifying firms known to be qualified for the proposed work. Copies of the contract documents for specific projects are filed with area plan rooms for the convenience of potential bidders and are available for inspection and purchase at the offices of the District.     The qualifications of the low bidder are reviewed to ensure that they meet minimum requirements; such as, a permanent place of business, adequate plant and equipment, adequate financial resources, appropriate technical experience, and satisfactory work history. Contracts are awarded to the lowest responsive and responsible bidder.

    Contractors are encouraged to send current information to the Metro District regarding their qualification to perform particular types of work. Those interested in performing as subcontractors may contact the Metro District for a list of the current holders of contract documents.
    Government Contracts and Price Agreements

    Bid solicitation by the Metro District shall not be required for acquisition of materials, equipment, or services when the goods are available through use of other governmental contracts or price agreements when, in the opinion of the Purchasing Officer, the government unit is considered to be the source of the lowest price.
    Conflict of Interest

    Directors:
    No member of the Board of Directors shall be interested in any contract or transaction with the Metro District except in an official representative capacity.

    Employees:
    As a political subdivision of the State of Colorado, the Metro District is obligated to act in the best interest of the people of the metropolitan area. It is imperative the Metro District develop and maintain the public's trust. Therefore, it is extremely important that no employee engage in any activity that may be considered a conflict of interest with day-to-day operations or overall objectives of the Metro District.

    The acceptance of gifts or free services by an employee from suppliers, contractors or other organizations may be considered a conflict of interest. In a more general sense, an employee's interests conflict with those of the Metro District when the employee profits or is in a position to profit, directly or indirectly, through use of the particular Metro District position.

    No employee or agent of the Metro District shall be interested in any contract or transaction with the Metro District except in an official representative capacity, or as provided in a contract of employment with the District.
